Harrisburg mayoral candidate Nevin Mindlin challenges a lower court ruling that removed his name from the November 5, 2013, general election ballot. Mindlin’s attorney, Lawrence Otter, has filed an appeal of the August 15, 2013 order of Dauphin County Court of Common Pleas upholding a petition requesting Mindlin’s name be removed. The court agreed that Mindlin’s nominating petition did not list a committee that would appoint a replacement to Mindlin should Mindlin be unable to finish the campaign.
In the appeal Otter listed 15 points of law, some of which have constitutional basis, in a statement of issues challenging the lower court ruling.
Arguments on the appeal are scheduled for 9:30 am September 12, 2013 at the Commonwealth Court in Harrisburg.
