The Harrisburg man arrested for assaulting an off-duty state trooper at a midget football game waives his right to a preliminary hearing.
Damien Jones, 29, is accused of knocking the trooper to the ground and attacking him on Sunday, September 15th. Authorities say it happened after a fight between cheerleaders broke out of a midget football game in Cumberland County.
Brother of Jones, Antonio Eubaks says his brother’s actions are justified because he was trying to protect his niece in a fight.
“Any uncle in their right mind would do what he’ done. I don’t think it was inappropriate,” says Eubaks.
Defense attorney, Bryan Walk says, “We’re not disputing if there was physical contact with the state trooper, this issue was whether Mr. Jones knew the state trooper was a state trooper.”
Walk says Jones’ charged are too severe for what happened. He’s charged with aggravated assault, simple assault, harassment and disorderly conduct.
Cumberland County Senior Assistant District Attorney, Dan Sodus says the case should be resolved before it goes to trial.
Jones is in custody in Cumberland County Prison.
