The Upper Darby man who police say killed a 7-month-old baby is scheduled to be in court today for a preliminary hearing.
Police say Ummad Rushdi shook 7-month-old Hamza Ali to death, then drove to our area and possibly buried the baby.
Rushdi faces a slew of charges from tampering with evidence to kidnapping, 9 in total.
But the most serious of them is murder — and according to the District Attorney in Delaware County, the state could seek the death penalty as punishment.
Hamzi Ali’s mother reported the baby missing on August 6th.
Police searched for weeks in York and Lancaster Counties for the body after they learned that Rushdi had told his brother that he had buried the baby.
“We are looking for a baby but it`s like finding a needle in a haystack,” said Upper Darby Police Superintendent, Michael Chitwood.
Police seized boxes of evidence and a large shovel from Rushdi’s home on Castle Pond Drive in Windsor Township in August.
Rushdi’s next door neighbor, Jeff Miller, thought something was up after noticing his behavior earlier this month.
“He`s come to the house and stayed with it but this particular day, Monday a week ago he was in and out several times with it…we found that to be odd,” says Jeff Miller.
According to court documents, Rushdi told Hamza Ali’s mother he gave the baby a proper Muslim burial.
But he told police they will never find the baby.
“Beyond the defendant telling us where that baby is, we will need a miracle,” says Chitwood.
Police say this wasn’t the first time Rushdi had harmed the baby.
Ali’s mother told police he had mistreated the baby in the past but she was too afraid to report anything.
