A man who tortured a dog will still be allowed to own animals, a Pennsylvania judge said Thursday.

The dog suffered traumatic injuries, and court papers said Seese “intended to destroy the dog with a firearm,” the paper reported.

The Pike County District Attorney’s office pressed county Judge Joseph Kameen to prohibit Seese from owning any animal and getting a job involving animals for two years. But Seese’s attorney, Wielaw Niemoczynski, said the animal ban was extreme because his client didn’t have a history of abusing animals.

Kameen on Thursday declined to add the animal ban to his decision to fine Seese $1,000, effectively allowing Seese to obtain another animal.

A phone call placed by FoxNews.com to Niemoczynski’s office late Thursday was not immediately returned.

The dog has since been moved to an animal rescue facility near Pittsburgh, where she’s gained weight, worked with a behaviorist and is being readied for adoption.

The dog Lexi has now been renamed Jaynah and has been recovering at Divine Destiny Rescue Inc.
