The Republican dominated U.S. House votes 231 to 187 to hold former Internal Revenue Service official Lois Lerner in contempt of Congress for refusing to answer questions about the IRS targeting of conservative and other groups.

The vote brings into focus three sharp divides in a deeply divided federal government: balance of power issues between the three branches, political questions over the IRS scandal and Constitutional questions over Lerner’s exercise of her Fifth Amendment right.

The House also voted 250-168 to call on Holder to remove the IRS investigation from the Department of Justice and instead appoint a special counsel to look into the scandal.
