A federal appeals court ruled Tuesday that The University of Texas can continue using race as a factor in undergraduate admissions.
The court ruled that eliminating race from admissions would hurt diversity on the campus.
The original lawsuit was filed by undergraduate applicant, Abigail Fisher, who is white and was denied admission to the university in 2008.
Fisher claims the university’s affirmative action efforts amounted to racial discrimination.
She plans to continue with her lawsuit.
