HARRISBURG, PA (WPMT) A Commonwealth Court judge halts part of an executive order by Governor Tom Wolf that critics claim is an illegal attempt to unionize home care workers.

President Judge Dan Pellegrini issued a preliminary injunction order preventing the Wolf administration from entering into written agreements under Executive Order No. 2015-05 while a lawsuit is pending.

Wolf’s Executive Order issued on February 27 creates an advisory group on care workers and directs his human services secretary to meet with people who represent workers paid through a state program.

Judge Pellegrini’s order means that meetings to discuss issues of mutual concern can’t result in written memorandums of understanding.

David W. Smith, a direct care participant and Donald Lambrecht, employed by Smith as a home care worker. have filed a legal challenge to Executive Order No. 2015-05, claiming it exceeded Governor Wolf’s authority.
