YORK COUNTY, Pa. – A York County man is behind bars charged with raping a female co-worker while she was unconscious.

On Saturday May 16, Fairview Township Police was contacted by Hanover Hospital to advise they had a patient in their facility who alleged that she had been sexually assaulted the night before.

The victim said that on the night before, Friday May 15, she had been out with co-workers. One of those co-workers was Domingo Mendez-Usebio, 40, formerly of the 500 block of Salem Road. The victim said that they were drinking beer and smoking marijuana at Mendez-Usebio’s home on Salem Road. The victim advised that she began feeling very intoxicated despite only having consumed a few beers over the course of the evening.  She told Mendez-Usebio that she was very tired and asked to lay down so she could sleep. Mendez-Usebio placed a sheet on the floor in a back bedroom. The victim said she remembers nothing after having fallen asleep.

The victim woke up at approximately 9:30 the next morning. She was in a state of partial undress and noticed physical evidence of sexual activity. She immediately left and went to Hanover Hospital.

Police interviewed Mendez-Usebio on Monday, May 18. During the interview he said that the victim told him she did not want to have sex with him. Mendez-Usebio also denied engaging in sex with the victim.

Police interviewed Mendez-Usebio again on June 2. During this interview, he admitted to engaging in sexual intercourse with the victim despite her telling him no.

Following arraignment on the rape charge bail was set at $75,000. Mendez-Usebio is also being held at the York County Prison on an unrelated charge.
