Genesee County, MI —  A Michigan woman is fighting to have her tubes tied after she gives birth to her third child.

But her fight has turned into a battle between medical needs and religious rights.

Jessica Mann, 33, has a brain tumor and her doctors have told her not to have any more children according to WJRT.

She plans to give birth under anesthesia, and would like to have her tubes tied at the same time, so as not to have a second surgery.

Her hospital, Geneys Health System has refused the procedure citing religious beliefs because it is a Catholic healthcare system.

Mann enlisted the help of the ACLU, and are hoping the hospital reconsiders.

ACLU spokesperson Brooke Tucker says, “They are forcing someone to undergo an unnecessary surgery that is life threatening for no legitimate reason. That is a clear case of not adhering to medical standards.”

Genesy released a statement to WJRT saying, “As a Catholic healthcare system, we follow the ethical and religious directives of the church. Beyond that, we can’t comment on this patient’s particular case.”

They have given the hospital until Friday to respond, before they consider going to court or the state.

The ACLU says there’s potentially a case for malpractice if Jessica has to get  a second surgery to get her tubes tied at another hospital.

Jessica says she can’t just go to another hospital, because her doctor only has admitting privileges at this one hospital. And at 34-weeks pregnant, she doesn’t want to find a new OBGYN.
