Colorado Springs, Colo. — Victims of a shooting at the Colorado Springs Planned Parenthood clinic in November filed a lawsuit against the organization, alleging Planned Parenthood did not provide adequate security.
The family of Ke’Arre Stewart, who was killed by the shooter, and Samantha Wagner, who was shot in the arm, filed the suit.
“[Planned Parenthood] of Colorado provided little or no security at the [clinic], such as an armed guard and perimeter fencing, as they do in other clinics. It provided no signs, posters, verbal or any other type of warning,” the lawsuit said.
Planned Parenthood of the Rocky Mountains said its facilities are safe.
“Although we cannot comment on ongoing litigation, we believe that our health centers throughout the Rocky Mountain region are both safe and inviting for our patients and our staff who care for them. The safety of our patients, staff and facilities is, and always has been, a priority for us,” spokeswoman Whitney Phillips said.
The national Planned Parenthood organization is also named in the suit. It did not immediately respond to CNN’s request for comment.
Accused shooter found incompetent
Earlier this month, a judge ruled the accused shooter, Robert Lewis Dear, was mentally incapable of participating in the case against him.
In an interview with a detective after his arrest, Dear offered a number of “delusional beliefs,” authorities said.
Police said Dear held authorities at bay for nearly six hours in the November incident, killing one police officer and two civilians before he was arrested.
Dear, 57, is charged with 179 felony counts including murder and attempted murder.
Similar lawsuit in Aurora Theater Shooting
Late last week, a Colorado jury debated a civil cased filed against Cinemark Cinemas stemming from the Aurora Movie Theater shooting in 2012.
That suit also alleged negligence, saying the theater lacked adequate security or sufficient alarm systems.
In less than a day of deliberations, the jury decided Cinemark was not liable.
