HARRISBURG, Pa. — On Tuesday, Dec. 13 David McCain, 23 of Harrisburg, was convicted of charges that stemmed from a May 18 incident in Susquehanna Township.

On May 18 police responded to an armed robbery of the 76 Gas Station at 2201 Herr St.  Officer Jesse Foltz from the Penbrook Borough Police Department responded and observed a man that fit the description of the robber walking at a fast pace a few blocks away from the gas station.

When Foltz patted down McCain he felt a handgun and then a struggle ensued.  McCain ran from the scene but was caught a short distance away.

Police determined McCain was not responsible for the robbery.  However, McCain was not allowed to possess the handgun due to a 2012 robbery conviction.  When police researched the handgun they determined that it was stolen from a car in Harrisburg three days earlier.

McCain was convicted of Aggravated Assault of a Police Officer, and Theft and Firearm offenses.

He was sentenced by Judge Scott Evans to three to seven years of incarceration in a state correctional institution.
