Lancaster County District Attorney Office says no charges will be filed in the February 13, 2013 shooting death of teenager David Montes.  An investigation revealed that Montes and two other individuals went to the home of Ismar Martin in the 400 block of North Queen Street in Lancaster.  The individuals got into a dispute over some money.

A verbal confrontation escalated when Montes punched Martin in the face. Martin said that Montes and his two companions appeared to draw firearms.  In response, Martin said he drew his own firearm and fired two shots as he retreated back into his home. One of the rounds struck Montes in the chest. The 17 year old was declared dead a short time later at Lancaster General Hospital.

The DA’s office said it was also clear one gunman fired at Martin. A revolver with one spent round in the cylinder was found near where Montes was found by police.

The report concludes that Martin was confronted at his home by one or more armed who physically assaulted and drew at least one firearm on him.  And at least one shot was fired at Martin as he stood in the doorway of his home, the case does not warrant filing any charges against Martin.
