On Christmas morning Janorris Hughes broke into the Franklin County home of Mickle Shaffer and tried to rob him and Shaffer’s friends. Police say Hughes was armed with a .22 caliber rifle. A fight allegedly broke out and Hughes used the rifle to shoot one of Shaffer’s friends before dropping the gun and running away.

That’s when Shaffer took action. Rob Hicks is a Pennsylvania State Trooper. He said that Hughes “brought the rifle back into the residence, he loaded it up with some of his own ammunition, grabbed a flashlight, made some comments about what he was going to do to the robber and he actually started to search for the robber.”

Roughly half an hour later Shaffer found Hughes and shot him in the back. FOX 43’s Legal Analyst said the act went beyond the limits of Pennsylvania’s Stand Your Ground Law of self defense. “If everything occurred within the home and there was the display of the weapon and the fear I think Mr. Shaffer would have been justified” said Breit.

Shaffer now stands charged with murder. “What Mr. Shaffer did by tracking him down was creating his own peril by putting himself in a situation where deadly force could be used but unlawfully” said Breit.
