Before the hearing the District Attorney’s Office withdrew a manslaughter charge against the infant’s father Eric Clapper, 34, because “he is incompetent to stand trial because of his intellectual disabilities.” That charge was the only charge Clapper faced.

The 2-month old child was born prematurely and died after being in the care of his parents for a month, investigators said.

According to Autopsy findings, the child suffered from dehydration and malnourishment.
