Convicted sex offender Jerry Sandusky is in prison but his list of alleged victims is still growing, and now one of them is suing the the state Attorney General for failing to prosecute his case.

Anthony Spinelli, Jr. says Sandusky sexually assaulted him in June of 1988 when he was attending a recruitment camp at Penn State. His lawyer says he lived with the shame and guilt for years.

"From being recruited as a top 1A quarterback by such schools as Michigan, Syracuse, and Penn State, his life spiraled to a life of drugs, alcohol and criminal activity," says attorney Steven Passarello.

But now Spinelli wants his day in court, and he's suing Attorney General Kathleen Kane to get it.

In 2011, as the other cases were being prosecuted, Spinelli came forward with his story. But he said the Attorney General's office did nothing.

"For some unknown reason, no action was taken by the Attorney General's office and his voice was silenced," says Passarello.

His attorneys then filed a personal criminal complaint at the end of last year and the Attorney General's office called Spinelli's case "compelling." But they denied the complaint because of the statute of limitations.

Now Spinelli's lawyer has filed an appeal in court.

Because the statute has changed over the past decade, victims can now take a case to court up until they're 50 years old. Spinelli is 43.

Some advocates say the statute of limitations should be abolished completely.

"If we get rid of the statute of limitations altogether, it does make it possible that for some of those cases they can still come forward and hold an offender accountable, and ultimately, that's in the best interest of public safety," says Kristen Houser of the PA Coalition Against Rape.

The court will set a hearing for the case. Sandusky is currently serving 30 to 60 years in prison on 45 counts for child sex abuse crimes.
