DAUPHIN COUNTY, Pa.– A man is headed to prison after a DUI conviction.

Matthew Walton was convicted of Driving Under the Influence on June 1, and was sentenced to 3 days to 6 months in Dauphin County Prison.

On June 30, 2015, Walton was driving in the area of Waltonville and Wyndham Roads in Derry Township when his car left the roadway and flipped over. Walton had suffered a fracture to his hand and a laceration to the forehead, but neither injury was considered serious.

While Officer Andrew Herr and an EMS worker testified that they had smelled alcohol at the scene of the crash, Walton refused a blood test at the hospital, making it impossible to determine whether he had consumed alcohol.

However following the trial, Judge Deborah Curcillo found that Walton was impaired to such a degree that was unable to safely operate his vehicle, leading to his sentence.
