LEBANON, Pa. – Lebanon County District Attorney says no criminal charges will be filed against Kelly Urban in the shooting death of her husband, 25-year-old David Urban. Urban died of a single gunshot wound on July 3rd in their Campbelltown apartment.

South Londonderry Township Police responded at about 12:57 a.m. to the couple’s apartment after a woman called to say that she had just shot her husband in the abdomen.  When officers arrived on the scene Kelly Urban visibly upset and crying walked out of the apartment with her hands in the air. Entering the apartment, police found David Urban lying on the bathroom floor. The gunshot wound was visible and Urban was semi-conscious. He was transported to Penn State Hershey Medical Center where he died from his injury.

Kelly Urban was interviewed by police on multiple occasions and each time she was consistent in describing the events leading up to the shooting. She said that she and her husband had been arguing for several hours. She said that he retrieved one of his handguns and then took her into the bathroom, where  he allegedly said that he was coming after her and then said that she would have to shoot him to stop him.

Urban said that her husband then shoved the gun into her hand and began to choke her. As she was nearing the point of losing consciousness she shot him. Urban claimed self defense in the shooting.

The subsequent investigation of the shooting by the Lebanon County Detective Bureau and South Londonderry Township Police in conjunction with the Lebanon County District Attorney’s Office included multiple interviews, forensic analysis of the crime scene, ballistic testing and an autopsy. The investigation also revealed that there was a history of domestic violence in the Urban’s marriage.

“The laws of self defense in Pennsylvania require that the Commonwealth prove that a person was not justified in her actions of defending herself with deadly force. Based upon all of the evidence collected in this investigation, there exists no evidence to prove that Kelly Urban was not legally justified in firing a handgun, and shooting David Urban. Based upon the evidence available to us and the application of the appropriate laws, she was justified because she reasonably believed deadly force was necessary to protect herself from death or serious bodily injury. For these reasons, no criminal charges will be filed against Kelly Urban,” said Lebanon County District Attorney David Arnold.
