ADAMS COUNTY, Pa. — An Adams County judge has revoked Jere Bagenstose's bail, sending him back to prison.
Bagenstose was charged in December 2022 with criminal homicide for the 1984 murder of his wife, Maryann Bagenstose, and was originally committed to Lancaster County Prison without bail.
In May 2023, his bail was set at $925,000 and Bagenstose was released after posting a bail bond.
Bail was reportedly set at that time due to the Pennsylvania Supreme Court’s decision in Commonwealth v. Talley, which required the trial judge to hold a hearing to determine whether bail should be set in the Bagenstose case.
The Commonwealth filed a motion last Tuesday to revoke Bagenstose’s bail and return him to county prison following the Pennsylvania Supreme Court’s ruling in Commonwealth v. Yard. Senior Judge John Kuhn granted the motion, ordering Bagenstose to report to Lancaster County Prison.
In Yard, the Supreme Court held that the Talley case dose not apply to homicide cases in which a defendant could be sentenced to life imprisonment without parole.
The Commonwealth filed a motion to revoke bail as a result of that decision. The motion was granted by Senior Judge Kuhn, who ordered Bagenstose to report to Lancaster County Prison by Monday.
He returned to Lancaster County Prison on Oct. 7.
Bagenstose's case is currently scheduled for trial in March 2025.
