York County winery officially closed after civil suit

Moon Dancer Vineyards and Winery has officially closed its doors and is expected to stay closed per a court order.

YORK COUNTY, Pa. — Sunday was the last day for people to visit Moon Dancer Vineyards and Winery after a York County judge ordered the property to stop all operations.

The business sits on a 50-acre vineyard on Klines Run Road in Lower Windsor Township.

The property is owned and operated by Jim Miller who lives on the same road.

In 2018, neighbors filed a complaint to the York County Court of Common Pleas, arguing the business violated covenants of the Lauxmont Farms Subdivision, recognized as an exclusive residential community in York County.

The suit cites violations such as the property operating as a business; and regularly hosting commercial events like concerts and weddings.

Plaintiffs also report commercial traffic on their private driveway.

A York County judge granted the motion for summary judgment in May, prohibiting the winery from conducting any commercial operations and was ordered to be used exclusively for residential purposes.

FOX43 reached out to the attorney representing Miller for comment about the decision but did not receive a response.

The attorney representing the plaintiffs declined to comment due to the ongoing litigation.

FOX43 also reached out to Lower Windsor Township to ask how a building permit was approved for the winery if it sits on a residential subdivision.

During their last day of business, Miller did express interest in seeking permission from the court to reopen while litigation continues but did not provide a timeframe of when that might be.

FOX43 visited the property during its final day in business to learn what the venue meant to customers.
