HARRISBURG, Pa. - Government activist Gene Stilp filed a constitutional action before the Pennsylvania Supreme Court in an effort to remove Attorney General Kathleen Kane from office.

Stilp wants the Supreme Court to force Governor Tom Wolf and the state senate to take action against Kane. Kane's law license is being suspended on October 21 as part of the investigation into crimes she is accused of committing. She faces charges of perjury, false swearing and contempt.

Stilp doesn't think Kane should be able to continue to work when she can't perform the duties of her job since she won't have a law license. "She can no longer be an acting attorney in the Attorney General's office. She will be paid all this money for doing nothing. So that should be reason for you to call your senators, your representative and say get her out of there," says Stilp.

The spokesman for the Attorney General's office, Chuck Ardo, fired back by saying, "Gene seems to have appointed himself both judge and jury while the process itself is still working itself out."

Stilp also filed a motion for the recusal of Republican Supreme Court Justice Michael Eakin.  He is under investigation because of the so-called "Porngate" scandal.  Eakin is accused of sending pornographic and racist emails.
