A former Cumberland Valley High School teacher who admitted to having sex with a student will likely receive a probationary sentence. Emily Nesbit pleaded guilty today to the crime of Institutional Sexual Assault, defined as a teacher engaging in sexual activity with a student 16 or older.
Nesbit waived her Preliminary Hearing and voluntarily permanently surrendered her teaching certificate. Those facts and consultation with the student and his family led prosecutors to agree to the probationary sentence, which is still subject to approval by the Court.
In a release, District Attorney Freed said, “One case involving a student and a school employee is too many. Unfortunately, we have faced numerous of these cases over the last decade. We will continue to pursue these cases because we recognize, as the legislature has, the special duty owed to students by school employees.”
Nesbit will be evaluated by the Pennsylvania Sexual Offenders Assessment Board prior to sentencing.
