YORK, Pa. – A York County jury finds Christopher Lee Schwenk, Jr., 26, guilty of third degree murder in the November 2013 shooting death of 49 year old Monique Nixon. The jury of nine men and three women returned with a verdict at about 2 pm.
It was around 3:30 am when Schwenk fired multiple shots from a 9 mm semi-automatic handgun at someone he thought was Eddie Gallon II, 37, a man Schwenk had confrontation with just minutes before over a woman. Nixon was about half a block away on South Queen, in York City, when she was fatally wounded.
Court of Common Pleas Judge Thomas Kelley polled each member of the jury to make sure that their verdict was unanimous. The same jury acquitted Schwenk, of first degree murder.
With his conviction, Schwenk faces a maximum sentence of 40 years in state prison. Formal sentencing will take place at a later date.
