Man and woman from Cumberland County found guilty of raping unconscious victim

CARLISLE, Pa. — A Cumberland County couple was found guilty of committing numerous sexual offenses against an unconscious victim last year, prosecutors said Tuesday.

According to County District Attorney Seán M. McCormack, Paul Wasser was convicted on Monday of rape of an unconscious person, involuntary deviate sexual intercourse, sexual assault, conspiracy to commit sexual assault, indecent assault, and conspiracy to commit indecent assault. 

His co-defendant, Kelly Prosser, was convicted of involuntary deviate sexual intercourse, rape of an unconscious person, conspiracy to commit sexual assault, and indecent assault. 

The couple was charged in February 2023, after the victim contacted authorities, McCormack said.

The victim reported that they had been invited to Wasser’s home after working an evening shift to socialize with Wasser and Prosser. The victim was told they could play darts and watch a movie, according to evidence presented at trial.

When they arrived, however, Wasser began pressuring the victim to consume alcohol. The victim reported that he provided them with multiple alcoholic beverages, and each time the drink was set down, he would pressure the victim to pick it back up and keep drinking. 

After drinking a mixed drink provided by Wasser, the victim told police they became dizzy and lost consciousness. 

The victim awoke on Wasser’s bed, with their clothing removed, and both defendants in various stages of nudity, prosecutors said.

The next day, the victim went to the hospital and underwent a sexual assault examination, where both defendants’ DNA was recovered, prosecutors said.

Upon being interviewed by police, both defendants denied any sexual contact with the victim, but Prosser later told an acquaintance, who testified at trial, that she did have sexual contact with the victim, according to prosecutors.

This case was prosecuted by Senior Assistant District Attorney Lauren Perchinski, who is assigned to the District Attorney’s Special Victims Unit, McCormack said.

Sentencing is scheduled for December 3.
