Hundreds of fish found dead near Brunner Island Power Station, DEP investigating

Brunner Island power plant faces lawsuit for polluting waters

YORK COUNTY, Pa. — The Department of Environmental Protection (DEP) has issued a notice of violation to Brunner Island Electric Station after 200 fish reportedly died. 

According to the DEP's notice of violation, officials responded to Brunner Island Steam Electric Station on Jan. 23 and Jan. 24 for two separate incidents. 

The report stated that on Jan. 23, there was a release of hydraulic oil from a maintenance project to Outfall 001, which discharges to the Susquehanna River. This is a violation of the NPPDES Permit and Sections 401 and 402 of the Pennsylvania Clean Streams Law. 

On Jan. 24, a fish kill was reported as a result of temperature fluctuations of non-contact cooling water, an industrial wastewater, caused by the planned shutdown of power generation units, which is a violation of Section 301 and 307 of the Pennsylvania Clean Streams Law. 

The DEP reportedly observed 200 dead fish. 

Officials with Brunner Island Electric Station must submit a written report on the cause of noncompliance and a summary of the event to the DEP by Feb. 7, according to the notice of violation. 

If the electrical station fails to comply with the outlined terms and conditions of Sections 301, 307, 401 and 402 of The Pennsylvania Clean Streams Law it constitutes a violation and subjects the business to appropriate enforcement action. 

The notice of violation is neither an order nor any final action by the DEP. It neither imposes nor waives any enforcement action available to the DEP under any of its statutes.
