The Pa. Supreme Court ordered documents unsealed in the grand jury investigation of Attorney General Kathleen Kane (D).

Kane's attorney, Lanny Davis, confirmed in a statement the grand jury recommended charges against Kane.

But, he added, "Special Prosecutor Thomas Carluccio failed to obtain evidence that the Attorney General illegally leaked documents."

He went on to say, "(Carluccio) comes up with utterly false, even absurd, charges that the Attorney General lied under oath, testified falsely, obstructed and 'oppressed.'"

Kane has been under investigation after details of a grand jury investigation of the head of the Philadelphia chapter of the NAACP appeared in a story in the Philadelphia Daily News.

The following is the entire statement Davis released:

Special Prosecutor Thomas Carluccio failed to obtain evidence that the Attorney General illegally leaked documents.  After all the leaks about his Grand Jury and his biased railroad train investigation Carluccio has come up empty.  Now we know why he resisted making these papers public.

What the Attorney General has said from the very beginning is true and it remains true: She never authorized any illegal leaks of Grand Jury information under Pennsylvania law.

So what does Carluccio do to camouflage his failure?  He comes up with utterly false, even absurd, charges that the Attorney General lied under oath, testified falsely, obstructed, and "oppressed."  But the Attorney General told the truth to the Grand Jury -- the whole truth and nothing but the truth.  What would be her motive to lie or obstruct or "oppress" if she did nothing wrong regarding illegal leaks?  You can't be guilty of obstruction or "oppression" if you are 100% truthful and have nothing to hide.

Now we know why the Special Prosecutor went to such lengths to keep these papers sealed.  With the light of day, everyone now knows he failed to obtain the recommendations of illegal leaking that he sought from the beginning, before he heard any evidence.  And to divert attention, he makes the false charges that the Attorney General had reason to lie or obstruct or "oppress" when she is innocent of the very charges that triggered his investigation.   

This matter is now in the hands of the Montgomery County District Attorney.  She has the discretion to look at all the facts and evidence anew and make her own judgment.

We hope that she will do so and that in her judgment it will be clear that Kathleen Kane told the truth, the whole truth, and nothing but the truth to the Grand Jury; and that these bogus charges recommended by Mr. Carluccio will not be pursued.
