YORK COUNTY, Pa. – Joseph Fitzpatrick, III may soon be a free man. On Tuesday, York County Court Judge Richard K. Renn, citing insufficient evidence at trial to support the jury’s verdict, tossed out Fitzpatrick’s first degree murder conviction for killing his wife. The same day of his conviction May 13, Fitzpatrick was immediately sentenced to life in prison. His defense attorney Chris Ferro, also immediately filed an appeal challenging the verdict.
Following yesterday’s acquittal order Ferro filed a motion Wednesday morning for his client’s release and/or bail pending an appeal by the York County District Attorney. At 12:37 pm this afternoon an order for the immediate release of Fitzpatrick from the custody is awaiting Judge Renn’s signature. Fitzpatrick is being held at the State Correctional facility in Camp Hill.
